CCPA Job Applicant Privacy Notice and Notice at Collection  

Vision Service Plan and its affiliates and subsidiary companies (“VSP”) is committed to protecting your privacy. This Privacy Notice and Notice at Collection (“Notice”) explains how we collect and use your personal information as part of the recruitment process). VSP adopts this Notice to comply with the California Consumer Privacy Act of 2018 (the “CCPA”).

This Notice is applicable to all job applicants who are residents of California and serves to inform you about the categories of personal information collected by VSP at or before the point of collection, the purposes for which this information is collected or used, and the third parties with whom this information is shared.  This Notice also specifies the retention period for such personal information. Additionally, this Notice provides California residents who are VSP job applicants with information regarding certain rights granted to them under the CCPA.

Personal Information: Personal information is defined under the CCPA as information that identifies, relates to, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with an individual or household. Personal information does not include information that is publicly available, deidentified information or aggregated consumer information.

Where VSP Gets Personal Information: VSP may collect personal information about job applicants from the following sources:

    • Directly from job applicants.
    • Prior employers, references, recruiters, VSP employee referrals website, and/or job-related social media platforms.
    • Third-party sources of demographic information.
    • Third-party companies, such as background check companies or drug testing facilities, if applicable.

The Categories of Personal Information (including Sensitive Personal Information) that VSP Collects: VSP may collect the following information from job applicants:

Your name, postal address, email address, driver’s license number, passport number, Internet Protocol Address, government-issued identifier (e.g., Social Security number), and unique identifiers (e.g., employee ID).

Your name, Social Security number, physical characteristics or description, address, telephone number, passport number, driver’s license or state ID card number, federal identification information authorizing work in the U.S.

Characteristics of Protected Classifications Under California or Federal Law

Your age, marital status, gender, sex, race, ethnicity, military/veteran status, information regarding your medical condition or physical or mental disability.

Internet or Other Electronic Network Activity Information 

Interactions with our recruitment website; information collected if you use our online application portal such as your IP address, browsing activities, and log data.

Professional or Employment-Related Information

Your resume or Curriculum Vitae, cover letter, previous and/or relevant work experience or other experience, education, transcripts, or other information you provide to us in support of an application and/or the application and recruitment process; reference information and/or information received from background checks (where applicable), including information provided by third parties; information about your educational and professional background from publicly available sources, including online sources, that we believe is relevant to your application or a potential future application (e.g. your LinkedIn profile); information relating to any previous applications you may have made to VSP for which you authorized VSP to retain those records for future reference and/or any previous employment history with VSP.

Non-Public Education Information (as defined in the Family Educational Rights and Privacy Act 20 U.S.C.1232g, 34 C.F.R. Part 99)

Non-public educational records and transcripts from schools that receive funds under an applicable program of the U.S. Department of Education.

Sensitive Personal Information

Social security number, driver’s license number, state identification card, or passport number. Note that racial and ethnic origin as well as religious and philosophical beliefs are optional and not required by VSP.

 

How VSP Uses Your Personal Information (including Sensitive Personal Information): VSP may use the personal information we collect about job applicants for the following purposes:

  • Evaluating your qualifications for employment.
  • Verifying the information you provide during the application process.
  • Communicating with you about your application, interviews, or related matters.
  • Conducting background checks (with your authorization, if required).
  • Complying with legal and regulatory requirements.

Disclosure of Personal Information: VSP may share information belonging to job applicants with the following third parties:

  • Background check providers - If the applicant is hired, the onboarding process may involve verifying their employment history, education, criminal record, or credit history after the offer letter is issued, with your consent.
  • Staffing or Recruiting Agencies - These parties may assist in the hiring or recruiting process.
  • Testing or Assessment Services - For skills tests, or other pre-employment evaluations, as applicable.
  • HR Technology Platforms - For managing applicant tracking systems (ATS) or onboarding processes.
  • Legal and Compliance Services - If there are legal reviews or compliance audits related to the hiring process.
  • Payroll or Benefits Providers - If the applicant is hired and onboarding requires sharing with external payroll or benefits administrators.
  • Affiliates - Within our corporate group for internal business purposes.

Sharing and Selling of Personal Information:  VSP does not sell or share (as those terms are defined under the CCPA) personal information about job applicants.

Data Retention: VSP retains personal information belonging to job applicants for as long as necessary to fulfill the purposes outlined above, and in accordance with VSP’s data retention schedule, unless a shorter or longer period is required by California or Federal law.

CCPA Rights Requests: The CCPA provides job applicants who are California residents with the following rights:

  • Right to Know: The right to request disclosures about or access to the specific pieces of personal information and categories of personal information that we have collected from them, the sources of the information and the business purpose for the collection as well as the categories of third parties we may have sold or shared your information with, subject to the statement above regarding the sale and sharing of personal information.
  • Right to Delete: Request deletion of your personal information, subject to certain exceptions.
  • Right to Correct Inaccurate Personal Information.
  •  Right to Limit the Use and Disclosure of Sensitive Personal Information: You have the right to limit the use and disclosure of sensitive personal information to certain purposes allowed by the CCPA. Except for information collection and processing as described previously, we do not collect any “sensitive personal information.”

Updates to This Notice

VSP may update this Notice from time to time. Changes will be effective upon posting the revised Notice to our website or by notifying you directly.
